1. Scope
This page summarises the disclaimers that apply when you visit https://uptimia.com (the "Website") and use the Uptimia service. The operative contractual disclaimers and limitations of liability are in our Terms of Service, and the statutory disclosures for content and link liability under § 7 DDG and Articles 4–6 and 8 of the Digital Services Act (Regulation (EU) 2022/2065, "DSA") are in our Imprint. This page does not create rights or duties beyond what is set out in those documents — where this page diverges in wording from the ToS or Imprint, the ToS and Imprint control.
2. Reliance disclaimer — Uptimia reports what its probes observed
Uptimia is an observability platform: it measures the availability and performance of your monitored resources from a distributed multi-region probe network and reports what our probes observed at the times they observed it. Uptimia is not the operator, hosting provider, ISP, or network carrier of your monitored resources. Our measurements cannot themselves cause or prevent an outage of those resources.
Probe results can be affected by:
- Network conditions on the probe side and on intermediate paths between the probe and your monitored resource
- DNS propagation timing and geographic routing decisions
- Rate-limiting that your hosting provider or upstream applies against our probes
- Transient errors on our own probe infrastructure (individual probes occasionally go offline for maintenance, redeploys, or unrelated incidents) — see Privacy Policy § 5.3 for the current list of probe-network providers
We use industry-standard practices to reduce false positives (multi-region confirmation, retries with backoff) but we do not represent that Uptimia's records are a definitive record of every event affecting your monitored resources, particularly events that were transient or geographically localised. We strongly recommend you cross-check critical incident events against your own server logs, application telemetry, or upstream-provider status pages before basing operational decisions on Uptimia's records alone. This applies in particular to:
- SLA credit calculations or SLA breach attributions you make against your own customers or vendors
- Postmortem root-cause conclusions
- Capacity-planning or scaling decisions
- Decisions to disable, change, or rely on failover, alerting, or incident-response systems
Free public tools (availability test, speed test, etc.)
The free public tools we provide on uptimia.com — including the free availability test and the free speed test — report a point-in-time measurement from a small probe set and are made available for the convenience of visitors evaluating Uptimia. They are not equivalent to the multi-region monitoring that an Uptimia subscription provides, and they must not be used as evidence of sustained availability or unavailability of any resource, for SLA proof, or for any decision with operational or commercial consequence. 3. Information on marketing pages
The information on https://uptimia.com — including blog posts, product pages, pricing pages, feature pages, status-page screenshots, and documentation — is provided in good faith and with reasonable care. Statements about our probe network, integrations, retention periods, feature set, and pricing are accurate at the time of publication. Capability and pricing change over time. For binding statements about what your subscription includes, refer to the subscription plan you selected at checkout and the ToS.
Competitor comparisons
The Website includes pages that compare Uptimia to named third-party monitoring products (for example, Pingdom, Statuspage, SpeedCurve, Checkly, LogRocket). Comparative advertising is permitted in Germany under § 6 UWG, provided that the comparison is objective, relates to features that are relevant and verifiable, and is not misleading. We design our comparison pages to meet those conditions: they are based on our own research of those vendors' publicly listed prices and feature pages at the time of publication, they compare on the same feature dimensions where the vendors offer a comparable feature, and they reflect our good-faith reading of what each vendor offered on that date. Third-party prices and features change without our knowledge; if a published comparison is materially out of date and you tell us, we will correct or remove it. Third-party names and logos are used solely for nominative identification of the vendors compared. The named third parties are not affiliated with, endorsed by, or partners of JJ Online GmbH unless we explicitly say so.
Third-party scripts loaded on this Website
The Website loads a small set of third-party and sister-product scripts (cookie banner, in-app chat widget, affiliate-attribution script, Real User Monitoring beacon) as described in our Cookie Policy § 4. Those scripts and their providers are responsible for their own behaviour; we are responsible for selecting them and for the data flows they create, as detailed in the Privacy Policy.
4. Limitation of liability
To the extent permitted by German law, we exclude liability for slight negligence (leichte Fahrlässigkeit) on duties that are not essential to the contract.
The following statutory protections cannot be excluded and are not affected by anything on this page:
- Liability for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit)
- Liability for damage to life, body, or health (Verletzung von Leben, Körper oder Gesundheit)
- Liability for breach of essential contractual duties (Kardinalpflichten / wesentliche Vertragspflichten) — limited to the foreseeable typical damage
- Liability under the German Product Liability Act (Produkthaftungsgesetz)
- Mandatory consumer protections applicable to consumers as defined in § 13 BGB (in relation to an entrepreneur as defined in § 14 BGB) — including the AGB rules in §§ 305 ff. BGB, the distance- and consumer-contract rules and statutory withdrawal right in §§ 312 ff. and § 355 BGB, and the rights granted by Directive 2011/83/EU as transposed into German law
- Liability arising from a guarantee (Garantie) we have expressly assumed
The contractual limitation of liability and the related disclosures in the ToS (Disclaimers and Limitation of Liability sections) are the operative provisions — this page paraphrases them for marketing-page compliance.

Where this Website links to third-party websites, those links are provided for convenience. We have no influence over the content of the linked sites at the time you visit them. At the time the link was placed, we had no knowledge of any unlawful content on the linked site.
Under the general civil liability principles applicable to outbound links — and consistent with the actual-knowledge standard reflected in § 7 DDG (which points to Articles 4–6 and 8 of the Digital Services Act, Regulation (EU) 2022/2065 ("DSA")) — our liability for the content of linked third-party sites arises only upon actual knowledge of a concrete legal violation. We will remove or disable any link as soon as we become aware of such a violation. This Disclaimer does not extend further than § 7 DDG and the corresponding DSA provisions actually permit — we do not claim categorical immunity for the content of linked sites.

The content and software on this Website (including the Uptimia brand, product UI, documentation, probe-network architecture diagrams, status-page templates, marketing copy, and code) is protected by German copyright (UrhG) and, where applicable, by EU copyright and database-rights legislation. Use beyond the limits of the Urheberrechtsgesetz requires our prior written consent.
Third-party content that appears on this Website is marked as such where we are aware of it; if you notice a copyright violation in our content, please tell us at admin@uptimia.com and we will remove or correct it without delay.
